Vindictive Trump vanquishes Vindman: Darcy cartoon - cleveland.com

CLEVELAND, Ohio -- President Trump sought deferments from serving the United States in the Vietnam, but bone spurs didn’t defer Trump from retaliating against decorated Lt. Col. Alexander Vindman for following his oath and a federal subpoena to testify honestly during Trump’s Impeachment hearings.

Friday, Trump ousted Vindman from his assignment on the National Security Council where he served as an expert on Ukraine. Deferment Donald then attempted to further wound the Purple Heart recipient with humiliation by having the Lt. Col. escorted off White House grounds by security.

Hours later, Trump also removed Gordon Sondland as Ambassador to the European Union. Like Lt. Col Vindman. Sondland had testified under subpoena during a U.S. House of Representatives hearing on Trump’s Impeachment.

Trump also removed Vindman’s twin brother, Yevgency, from his position as an attorney for the National Security Council.

The actions, made two days after Trump was acquitted in a sham Senate Impeachment trial, were dubbed “The Friday Night Massacre” because they mimicked President Nixon’s “Saturday Night Massacre” during Watergate.

“Flushing out the pipes, it was necessary," a White House adviser told CNN. Except it wasn’t.

Trump retaliated against Lt. Col Vindman and Sondland despite being told by White House and military officials that both men had been making plans to leave on their own accord. The officials advised Trump against taking the action to spare himself the criticism that was certain to come and has, from both Republicans and Democrats.

Vindman’s removal does not violate the federal statute against witness retaliation, for two technical reasons. First, Vindman hasn’t been fired, he is being reassigned back to the Pentagon. Second, the House of Representatives is not considered a member of law enforcement. This how the statute 18 U.S. Code 1513 (e) reads:

Whoever knowingly, with the intent to retaliate, takes any action harmful to any person, including interference with lawful employment or livelihood of any person, for providing to a law enforcement officer any truthful information relating to the commission or possible commission of any Federal offence, shall be fined under this title or imprisoned not more than 10 years, or both.”

Even if the code did apply to Vindman, it would have been ignored by Trump, just as lawful subpoenas and the U.S. Constitution have been.

General Barry McCaffrey said in an interview that if a two-star General retaliated against Lt. Col Vindam the way Trump did, the General would have been fired under the Military Code of Justice.

Lt. Col Vindman received the Purple Heart for wounds suffered in Iraq War. He’s now been stabbed in the back with the Trump cold Yellow Heart.
